The terms of use and purchase determine the procedure for accessing, ordering, paying, delivering and complaining about products and services offered on the Wineluxe web store at the primary internet address www.wineluxe.hr. The mentioned website is owned by the trading company Wineluxe d.o.o., Frlanska cesta 3, Matulji, OIB: 49492940363.
All materials found on the online store are the intellectual property of Wineluxe d.o.o., and may be used only with the express permission of the copyright holder, trademark and/or design rights holder. Wineluxe d.o.o. enables the use of the services and content of the online store as regulated by these Terms of Use and Purchase.
Within the Web store, Wineluxe is in the role of the Seller, and the Customer is any visitor who orders one or more products from the Seller through the Web store or in some other way.
Terms of use and purchase form part of the contract concluded at a distance together with the specifications and prices of the purchased products, and before confirming the order, the Customer will be asked to accept them, or declare that he is familiar with and agrees with them. The seller reserves the right to change the conditions at any time, with the said changes coming into effect upon publication on the Web store.
When the Buyer confirms and executes the order, the contract is concluded, and the Seller will notify the Buyer by e-mail that the contract has been concluded. For a validly concluded contract, the Buyer must have full business capacity, that is, he must be an adult. The sale of alcohol is prohibited to persons under the age of 18. Responsibility for the accuracy and completeness of user data entered during registration, application and/or product ordering rests with the Customer. The Seller is not responsible for the violation of this provision, given that it is clearly and visibly stated that an adult is required to enter into a contract. When delivering the product, the Buyer bears the burden of proving that he/she is of legal age when taking over the goods. The delivery will not be made in case of suspicion that it is a minor, unless he provides proof of his legal age. Only their legal representatives can conclude a contract for persons who are completely incapable of business, and persons who are partially capable of business can only conclude a contract with the consent of their legal representative.
The User or Customer is personally responsible for protecting the confidentiality of passwords, in places where they exist as such. The user is obliged to provide accurate, complete and valid personal data when filling out the registration form. Acting contrary to this, authorizes the Seller to deny such a user access to or realization of all or part of the offered services.
In the event of an occasional interruption of the Seller’s services, which may be caused by technical reasons, and possibly during the transmission of information on the Internet, the User shall not hold the Seller responsible for any loss of data.
The seller reserves the right at any time and without prior notice, if he deems it necessary, to cancel or change the content of the General Terms and Conditions, the product range, the price of the product or the content of the website.
The web store is used solely at the User’s responsibility. The Seller is released from any responsibility for damage that may have occurred when visiting the Website due to illegal actions by third parties, computer viruses, interruption in the communication line, unauthorized access, inappropriate behavior, negligence, etc. and other cases for which the Seller is not responsible. The seller is released from any responsibility in the event of circumstances that prevent the use of the Web store. The terms of this chapter apply to the entire content of the website.
All contents posted on the Internet page are posted to facilitate the customer’s choice when shopping. The seller reserves the right to make mistakes in product descriptions and photos that are
informative and set according to the manufacturer’s information. We are not responsible for unintentional errors. Availability of the vintage: The year of the vintage of the wine that the Seller has for sale is not necessarily the year that is visible in the photo of the wine. If the Buyer wants a certain vintage year of the selected product, it is necessary to write the desired vintage year in the message to the seller when sending the order, so that they can prepare it for delivery if it is still available. The Buyer will receive an answer to every inquiry sent regarding the availability of the vintage before delivery.
The Consumer Protection Act (N.N.41/14, 110/15) applies to business conditions.

Features of products and services
The products in the Web store are presented with text descriptions and photos, and the information about them is compiled based on the Seller’s database. Product photos are illustrative in nature and do not always have to correspond in all details to the products that are the subject of the order. The seller especially points out that the visual identity of the product shown in the photo does not have to correspond to the appearance of the product in reality (which includes but is not limited to the screen settings of the device with which the user accesses the online store, the user’s perception of colors, the way the product is photographed, variations in printing, etc.). In the event of a discrepancy between the product shown in the photo and the delivered product, it is not a product defect.
Product information displayed on the online store is subject to computer errors, irregularities in the operation of the application and/or server, other technical irregularities, typographical errors, etc. The seller will try to provide the most accurate description and image of the product on the online store, but does not assume responsibility for the complete the accuracy of the given data. In the event of obvious errors or defects in product data, the Seller reserves the right to unilaterally terminate the contract.
The subject of the order can only be products for which it is indicated in the order that they are available and available. Due to the large number of orders that can be processed at the same time, it may happen that the information about the availability of the product is not the same as the state in the warehouse. If the ordered product is not available in the warehouse, the Seller will inform the Customer that the product is currently unavailable, about the time frame in which the product is available, and at the same time offer the possibility of purchasing an alternative product that is available for delivery.
Product price
Prices on the online store are expressed in euros (EUR), including VAT. Delivery costs are not included in the product price, as they are paid separately, except for orders above a certain amount when delivery is free, and all in accordance with the conditions and in the manner indicated in these Terms of Use and Purchase.
Before confirming the order, the price of the product with VAT is shown separately, the price of delivery if chargeable, depending on the quantity of ordered products and is shown together, and the final price so that the Customer has an insight into the final price he pays for the ordered products and services.
In the case of payment by Internet banking and a national payment order (which replaced payment by general money order), payment costs and/or interbank transactions are not included in the price.
